Terms of Service

About Us

Plan and Eat is operated by Plan and Eat LLC, registered in the Republic of Azerbaijan under TIN 1704113041, at AZ1003, Baku, Sabail district, Neftchi Gurban Abbasov street, building 5, apartment 5.

This Agreement sets out the terms for using our services. By using Plan and Eat, users confirm they have read and accepted these Terms of Service.

PLEASE READ THESE TERMS OF SERVICE CAREFULLY BEFORE USING OUR SERVICES.

Definitions

Plan and Eat — a food-service aggregator that organizes food and meal services for users.

Aggregator Service — intermediary services between users and third parties/suppliers that provide the selected services.

Corporate Subscriber — an employer whose employees use the Plan and Eat mobile app and/or website.

User — an individual registered in the mobile app/website, including employees of corporate subscribers and other registered individuals.

Supplier — a legal or natural person that provides food products to users under a separate agreement with Plan and Eat.

Meal Plan — a set of food products/services selected by users under a subscription package.

Subscription Package — a paid subscription selected in the mobile app/website.

Services — services offered by Plan and Eat within the scope of this Agreement.

OTP — one-time password sent by Plan and Eat and/or a bank.

Content — all materials, services, graphics, data, articles, images, and user-submitted materials.

Acceptance of Terms

Any person using Plan and Eat is deemed to have accepted these Terms.

Users acknowledge that electronic acceptance of these Terms has the same legal force and effect as a written signature.

Using Plan and Eat

Employees of corporate subscribers may use services after the relevant agreement is concluded with Plan and Eat. Other users may use services by registering directly in Plan and Eat.

To create an account, users provide personal details (name, surname, corporate email and/or email, phone number, service address) and set a password.

Users can access their account by entering the OTP code sent to their phone number.

After logging in, users can select a subscription package, start date, and plan duration, choose categories, review ingredients and supplier details, and confirm or replace suggested items where applicable.

Payment Terms

In return for services, users pay for their selected subscription package through the mobile app/website.

All payments are processed by third-party payment providers and gateways. Plan and Eat does not collect or store full bank card details.

If subscription payments are made by the user, renewal charges may be collected automatically according to selected settings.

If subscription payments are made by a corporate subscriber, renewal and charging terms are governed by the agreement between the Company and the corporate subscriber.

Service Description

Plan and Eat acts as an aggregator of food services and provides users with tools to plan weekly/monthly meal programs and choose categories according to their preferences.

Users can review ingredient information and supplier details for selected products.

Liability

Plan and Eat provides information and platform functionality to support service usage; however, product quality and user satisfaction are primarily the responsibility of relevant third-party suppliers.

Users should notify Plan and Eat within 11 hours after delivery if delivered food is not of expected quality.

Plan and Eat is not liable for products not received by users according to in-app/web procedures, or for defects caused by third-party service providers.

To the extent permitted by law, Plan and Eat is not liable for indirect or incidental damages arising from use of the Services.

All platform materials are protected by intellectual property rights owned by Plan and Eat, except for user personal data where applicable.

By uploading content, users confirm they have the right to upload it and bear responsibility for third-party claims related to such content.

Plan and Eat may remove user profiles or restrict access without prior notice in case of inappropriate content or violations, and refunds may not apply in such cases.

Cookie Policy

Cookies are small text files stored on your device. They may include IP address, browser type, usage time, and visited sections. We may use cookies and geolocation technologies to improve service quality, personalize content, run analytics, reduce risk, prevent fraud, and improve security.

Personal Data Collection and Use

Plan and Eat collects user personal data and service-related feedback/comments. This data may be used to provide services, improve quality, prevent abuse, and measure service usage.

Personal data is protected with appropriate security measures and modern standards to prevent unauthorized access or modification.

Data Sharing

Plan and Eat may share personal data with third parties where required by law or necessary for service delivery.

When cooperating with third-party providers (suppliers), Plan and Eat ensures data protection obligations are addressed through relevant agreements.

User Rights

  • Users may view and update their personal data.
  • Users may request deletion of their personal data.
  • Users may receive notice of updates to privacy and data-protection practices.

Account Termination Policy

Users agree not to violate these Terms, abuse supplier/partner staff, compromise account security, interfere with service infrastructure, send spam, scrape content, reproduce protected content, or attempt to extract source code/data unlawfully.

Final Provisions

Each user is considered to have unconditionally accepted all provisions of these Terms.

The parties retain the right to pursue legal remedies in relation to rights, obligations, liabilities, and claims arising under these Terms.

Dispute Resolution

These Terms are governed by the laws of the Republic of Azerbaijan.

Disputes arising from these Terms should first be resolved by mutual agreement. If unresolved, disputes shall be submitted to the competent courts of the Republic of Azerbaijan.

Other Terms

These Terms constitute the entire agreement between the parties regarding their subject matter and replace any prior oral or written agreements, representations, or statements.

If any provision is found unenforceable or invalid, it will be limited or removed to the minimum extent required, and the remaining provisions will remain in full force.

Plan and Eat may amend these Terms unilaterally at any time, with prior notice where applicable. Continued use of services after such changes means acceptance of the updated Terms.
